Sections 260.200 and 260.250:

This act allows yard waste to be disposed of in a municipal solid waste disposal area when the Department of Natural Resources approves the operation of the disposal area as a bioreactor and when the landfill gas produced will be used for electricity generation.

Sections 260.330 to 260.335:

These sections extend the period of time from October 1, 2009, to October 1, 2014, during which no annual adjustment shall be made to the per-ton fee required to be remitted to the Department of Natural Resources by operators of solid waste sanitary landfills and transfer stations except when needed to fund the operating costs of the Department. The act also extends for the same time period the provision that any adjustment made shall not exceed the percentage increase as measured by the Consumer Price Index for All Urban Consumers.

2007 Watch – Missouri Votes Conservation (MVC) Legislative Priorities

Missouri Votes Conservation (MVC) is a political action network that works to increase the political voice of the conservation community in Missouri.

Missouri Votes Conservation is a nonpartisan, statewide, nonprofit corporation affiliated with the League of Conservation Voters, a widely respected national organization that advocates for the environment through legislative channels. MVC is the only conservation organization in Missouri that represents all conservation interests – environmentalists, hunters, anglers, farmers, conservationists, etc. – and the only organization that focuses on the political arena to achieve sound conservation practices.

MVC Legislative Priorities for 2007-2008
On October 14, 2006, 30 leaders of the conservation community representing 17 pro-conservation organizations met in Columbia, Missouri to develop legislative priorities for the 2007 General Assembly. 2007 Priorities: Renewable Energy, Sand and Gravel Mining, Tax Increment Financing (TIF). Supreme Court Rules on Flow Control

A much anticipated ruling from the US Supreme Court was made April 30, 2007, concluding in a 6-3 decision that, in effect, allows counties or solid waste authorities to flow control waste to facilities owned or operated by those public sector entities. The court ruled that this sort of flow control was different from the situation contested in the C & A Carbone, Inc. v. Town of Clarkstown in 1994. That ruling stated that "a so-called flow control ordinance, which require[d] all solid waste to be processed at a designated transfer station before leaving the municipality,' discriminated against interstate commerce and was invalid under the Commerce Clause because it "deprived competitors, including out-of-state firms, of access to a local market."

The Chief Justice delivered the opinion of the Court in this case, concluding that the Counties' flow control ordinances, which treat in-state private business interests exactly the same as out-of-state ones, do not discriminate against interstate commerce. Given its contrasting circumstances, the court ruled in this recent case, United Haulers Association, Inc. v. Oneida-Herkimer Solid Waste Management Authority, that flow control ordinances involving public facilities should be viewed differently than those involving privately held companies. The majority felt that "treating public and private entities the same under the dormant Commerce Clause would lead to unprecedented and unbounded interference by the courts with state and local government." LOCAL GOVERNMENT FLOW CONTROL UPHELD BY U.S. SUPREME COURT

On Monday, April 30, 2007, the U.S. Supreme Court issued a decision in the case of United Haulers Association v. Oneida-Herkimer Solid Waste Management Authority. By a 6-3 margin, the court ruled that local ordinance that directs locally generated wastes to publicly owned waste facilities does not discriminate against interstate commerce.
